Przedsiębiorstwa ubiegające się o Jednostkową Pożyczkę Regionalną dla MŚP muszą spełniać łącznie następujące kryteria:
- Są mikro, małym lub średnim przedsiębiorstwem,
- Posiadają na terenie województwa warmińsko-mazurskiego siedzibę lub oddział, zgodnie z wpisem do rejestru przedsiębiorców w Krajowym Rejestrze Sądowym albo stałe lub dodatkowe stałe miejsce wykonywania działalności gospodarczej, zgodnie z wpisem do Centralnej Ewidencji i Informacji o Działalności Gospodarczej i prowadzącymi działalność na terenie województwa warmińsko‑mazurskiego.
- Na Pośredniku Finansowym ciąży obowiązek potwierdzenia, że działalność Ostatecznego Odbiorcy na terenie województwa warmińsko-mazurskiego nie ma charakteru pozornego.
- Nie znajdują się w trudnej sytuacji,
- Nie znajdują się na liście osób i podmiotów objętych sankcjami w związku z wojną w Ukrainie, zamieszczonej na stronie Ministerstwa Spraw Wewnętrznych i Administracji.
- Nie ciąży na nich obowiązek zwrotu pomocy, wynikający z decyzji Komisji Europejskiej uznającej pomoc za niezgodną z prawem oraz ze wspólnym rynkiem lub orzeczenia sądu krajowego lub unijnego.
- Nie podlegają wykluczeniu z możliwości dostępu do środków publicznych na podstawie przepisów prawa lub wykluczeniu takiemu nie podlegają osoby uprawnione do ich reprezentacji.
- Nie są wykluczeni, stosownie do Rozporządzenia Komisji (UE) nr 1407/2013 z dnia 18 grudnia 2013 r. w sprawie stosowania art. 107 i 108 Traktatu o funkcjonowaniu Unii Europejskiej do pomocy de minimis (jeżeli przedsiębiorstwo ubiega się o pomoc de minimis).
- Nie są podmiotami, w stosunku do których Pośrednik Finansowy lub osoby upoważnione do jego reprezentacji posiadają, tak bezpośrednio jak i pośrednio, jakiekolwiek powiązania, w tym o charakterze majątkowym, kapitałowym, osobowym czy też faktycznym, które wpływają lub mogłyby potencjalnie wpływać na prawidłową realizację operację udzielania Pożyczki Regionalnej dla MŚP.
